Working Remotely from Italy Without a Work Permit: Why It Backfires
Last modified on November 5, 2026 • 5 min read • 972 words“I’ll just move and keep working remotely.” We hear this often, from employees and sometimes from their managers. For a non-EU national it is the most expensive shortcut in this whole topic. Here is why, and what to do instead.
The immigration problem
Entering Italy as a visitor does not give a right to work. Working from Italy for your foreign employer is still working in Italy. Without a permit that allows work, you are exposed: fines, refusal of future permits, problems at the border. And when you eventually apply for a proper permit, a history of irregular stay can count against you.
The tax problem
If you live in Italy for most of the year, you are likely to become tax resident. Income earned while working here is taxable here. Without Italian payroll, nobody withholds that tax, and you are responsible for it, with penalties if you do not declare it.
The social security problem
Social security is generally due where the work is physically done. A non-EU employer with no Italian presence, and an employee in Italy with no Italian contributions, is a gap that INPS can fill retroactively.
The company’s problem
For the employer, an employee working long term in Italy can create a taxable presence, a permanent establishment, especially if the person signs contracts or manages local business. And if the arrangement is a contractor agreement, it can be reclassified as employment.
Why people try it anyway
- They think the visa process is impossible without an Italian company.
- They think a short stay is fine, and it becomes long.
- They hear stories from EU citizens, who can move freely, and assume the same applies.
The clean alternative
An Employer of Record solves all four problems at once:
- Immigration: the EOR files the work permit, usually the Blue Card , as your Italian employer.
- Tax: Italian payroll withholds income tax every month.
- Social security: contributions go to INPS and build your pension.
- The company: you are employed by the EOR in Italy, not by your company. The company pays a monthly invoice and directs your work.
With ItalyBlueCard that costs €250 per month plus your employment cost, and €2,500 for the visa case.
What about EU citizens?
EU citizens do not need a work permit. They still need the tax and social security side handled. The same EOR structure applies, without the visa step.
What about short business trips?
Short trips for meetings or conferences are different from relocating. Rules on business visits depend on your nationality and the activity. Ask before travelling if you are unsure.
What about digital nomad visas?
Italy has introduced a permit for highly qualified remote workers. Its conditions differ from the Blue Card, and it does not make you an Italian employee. We have not verified its current requirements for this article; if it fits your case better, a specialised adviser can help.
If you are already in Italy
If you have already been working from Italy without a permit, do not ignore it. Talk to an immigration lawyer and a tax adviser about regularising your position. Then set up a proper structure going forward.
In short
The shortcut saves a few weeks and creates problems that last years. The proper route is predictable, and an EOR makes it possible without an Italian company. Tell us about your case .
Frequently, people ask
What if I am a dual national with an EU passport? Then you do not need a permit. You still need Italian payroll for long-term work here.
Can I work from Italy during the visa wait? No. Wait in your country of residence until the visa is issued and you have entered with it.
Is it different for a few weeks of holiday with a laptop? Occasional work during a short holiday is a grey area. Avoid anything that looks like moving your work to Italy.
Does the company risk anything if the employee hid the move? Yes. Authorities look at the facts, not at what the company knew. That is why companies increasingly ask staff to declare where they actually work.
How fast can the EOR route be set up? The structure itself is ready in days. The permit then follows the route timeline; the nulla osta for the Blue Card has a 30-day legal deadline.
