Permanent or Fixed-Term Contract: What It Changes for Your Italian Permit

When a company abroad hires you through an Employer of Record, one of the first choices is the contract type: permanent (a tempo indeterminato) or fixed-term (a tempo determinato). In Italy both are common. For a sponsored employee, the choice also shapes the permit.

The rule for the Blue Card

Article 27-quater, paragraph 11 is clear:

  • with a permanent contract, the Blue Card residence permit lasts two years;
  • with any other contract, it lasts the length of the employment relationship plus three months.

And paragraph 5 sets a floor: the contract or binding offer must last at least six months.

So a twelve-month fixed-term contract gives a permit of about fifteen months, and a renewal tied to a contract extension. A permanent contract gives two years, renewable while the job continues.

Why companies choose fixed-term

Companies abroad sometimes prefer fixed-term because they are testing a market or a project, or because they are used to at-will employment and see a fixed end date as a safety valve. In Italy, fixed-term contracts have legal limits on total duration and on renewals.

From the permit side, a fixed-term contract means:

  • shorter permit, earlier renewal;
  • a renewal that depends on the contract being extended or converted;
  • less certainty for a lease, a loan or a family reunification file.

Why we usually suggest permanent

A permanent Italian contract is not a life sentence. It includes a probation period, up to six months depending on the CCNL, during which either side can end it without notice. After probation, ending it needs a valid reason and the CCNL notice period, like any employment in Italy.

In exchange, the employee gets a two-year permit, a stronger position with landlords, and a simpler family file. For a company that is serious about the person, it is usually the better choice.

Part-time

Part-time contracts are possible and standard in Italy. For the Blue Card, what counts is the salary actually paid, so a part-time contract must still reach the threshold on its own. Few qualified roles do; plan for full time.

Converting later

A fixed-term contract can be converted into a permanent one. The permit is then renewed on the new terms. If you plan to convert, do it before the permit renewal so the renewal can use the permanent contract.

What happens at the end of a fixed-term contract

If the contract ends and is not renewed, you receive your final pay, TFR and unused leave. Your permit lasts three months beyond the contract. As a Blue Card holder you may look for another job during unemployment. Talk to us well before the end date: a new employer, or the same company through us on a new contract, needs time to arrange.

A short comparison

Permanent Fixed-term
Blue Card permit 2 years Contract length + 3 months
Minimum length for Blue Card - 6 months
Ends with Notice and a valid reason, or resignation The end date, or earlier for just cause
Landlords and banks Strong Weaker
Family file Simpler Tied to contract length

Our advice

If the company employing you expects the role to last, choose permanent with a well-used probation period. If it genuinely is a project, choose a fixed term long enough to be worth the move, and agree in advance what happens at the end. Read the contract behind the permit or ask us .

Doubts we clear up

Can a fixed-term contract be renewed indefinitely? No. Italian law limits duration and renewals of fixed-term contracts. We check the plan against the limits.

Does a permanent contract cost the employer more? The monthly cost is the same. The difference is in how and when the relationship can end.

Which is better for a mortgage? Banks strongly prefer permanent contracts that have passed probation.

Can I resign from a permanent contract? Yes, at any time, giving the notice set by your CCNL. A permanent contract binds the employer far more than the employee.

Does the contract type change my salary or benefits? No. Pay, leave, 13th month and TFR are the same; fixed-term employees have the same rights for the duration of the contract.

What if the company is unsure about Italy long term? A permanent contract with an EOR is still easy to end correctly if plans change, with notice and a valid reason. The company does not take on an entity it may later need to close.
