From Contractor to Italian Employee: Why a Move to Italy Needs a Real Contract

Many professionals work for a foreign company as contractors. Why that does not support an Italian work permit, and how converting to an employment contract through an EOR works.
From Contractor to Italian Employee: Why a Move to Italy Needs a Real Contract

A common story: a developer in Pune, a designer in Curitiba or an analyst in Izmir has worked for a European or American company as a contractor for years. Invoices every month, no employment contract. Now they want to move to Italy and keep the job. Can the contract simply move with them?

Usually not.

Why a contractor agreement does not work for the permit

The Blue Card and the ordinary work permit are both permits for employed work. They are requested by an employer in Italy, on the basis of an employment contract or a binding job offer of at least six months for the Blue Card. A services agreement with a foreign company is neither.

Self-employment permits exist, but they are a different route with their own conditions, and a Blue Card allows self-employment only alongside qualified employment.

Why it is also risky for the company

If a person lives in Italy and works only for one company, on its schedule, with its tools, under its direction, Italian authorities can treat the arrangement as employment. The company may then owe the contributions and taxes it should have paid, plus penalties. A long-standing contractor who moves to Italy and keeps working the same way is exactly that profile.

The conversion

The clean solution is to convert the contractor into an employee in Italy. If the company has no Italian entity, an Employer of Record becomes the employer:

  1. Agree the salary. The gross annual salary in euros, at or above the Blue Card threshold if that is the route.
  2. Draft the contract under the right CCNL, with level, hours, probation and an IP and confidentiality clause in favour of the company.
  3. File the permit with the EOR as employer.
  4. End the contractor agreement when the employment starts, so the two do not overlap in Italy.
  5. Run payroll from the first day.

How to set the salary

Contractors usually think in terms of a daily or monthly fee that covers everything. An employee’s salary is different: the employer adds about 30% in social contributions, plus INAIL and the TFR accrual. The 13th month and leave are paid too.

So the employment cost to the company is higher than the gross salary, and the employee’s net is lower than a contractor fee of the same size. Our cost calculator helps both sides find a number that works. A useful approach: start from the company’s current annual budget for the contractor, then work back to a RAL that keeps total cost close to it.

What the person gains

  • a work permit and residence in Italy;
  • Italian pension contributions;
  • public health care;
  • at least four weeks of paid leave, paid sick leave, parental leave;
  • the 13th month and TFR;
  • protection against dismissal without a valid reason;
  • a payslip that landlords and banks understand.

What the company gains

  • no reclassification risk;
  • no need to open an entity;
  • one monthly invoice, €250 plus the employment cost, in EUR or USD;
  • the IP of the work assigned by contract.

Seniority

Years as a contractor do not automatically count as employment seniority in Italy. If the company wants to recognise them, it can agree a higher level or above-minimum pay, or shorten the probation.

Tell us about your contract and we will propose the switch.

Before you ask

Can I stay a contractor until the permit arrives? Yes, while you live outside Italy. The employment contract starts when you start working in Italy.

Will my net income drop? Compared with a gross contractor fee, usually yes. But you gain pension, health care, leave and severance that a contractor pays for himself.

Who owns the work I did as a contractor? That depends on your contractor agreement. The new employment contract covers work done from its start date.

Can the company keep paying my invoices from abroad after I move? No. Once you live and work in Italy, the employment contract replaces the contractor agreement. Keeping both would recreate the risk the conversion removes.

What if I also have other clients? Tell us before signing. Your employment contract may limit side work, and the Blue Card allows self-employment only alongside the qualified job, not instead of it.
